Terms of Service
Article 1 (Purpose)
These Terms of Use (hereinafter referred to as the "Terms") apply to the use of "CUPICK" (hereinafter referred to as the "Service") operated by News and Coffee Co., Ltd. (hereinafter referred to as the "Company"). Applies to Users (as defined in Section 2) who: Users use this service after agreeing to these terms.
These Terms set forth the terms of use of this Service. All users who register for this service will use this service in accordance with the terms and conditions set forth in these terms, depending on conditions such as age and usage environment, in accordance with these terms.
This Agreement (as defined in Article 2) will be established between the User and the Company when the User agrees to these Terms.
Article 2 (Definition)
- “This Agreement”: Refers to the contract for the use of this Service concluded between the Company and the User, subject to these Terms of Use.
- “User”: Refers to everyone who has registered as a user of this service.
- “Products”: Refers to digital photo books, books, photographs, music, videos, and other publications that users purchase using the Service.
- “User Information”: Refers to the ID and password of the user registered with this service.
- “Communication equipment”: Refers to smartphones, tablet terminals, and computer equipment.
Article 3 (Application)
These Terms apply to the use of the Service and take effect when the User agrees to them. The Company may separately establish rules and policies (hereinafter referred to as "Individual Provisions") regarding the Service, which shall form part of these Terms.
Article 4 (User Registration)
A person wishing to use the Service must agree to the Terms and apply for user registration by the method specified by the Company. User registration is completed when the Company approves the application. The Company may refuse registration at its discretion.
Article 5 (Management of User Information)
Users are responsible for managing their User Information. The Company shall not be liable for any damages resulting from unauthorized use of User Information by a third party.
Article 6 (Prohibited Acts)
Users shall not engage in any of the following acts when using the Service:
- Acts that violate laws or public order and morals.
- Acts related to criminal activities.
- Acts that infringe on copyrights, trademarks, or other intellectual property rights.
- Acts that damage or interfere with the functions of our server or network.
- Acts that use the Service for commercial purposes without permission.
- Acts that impersonate another user.
- Acts that provide benefits directly or indirectly to anti-social forces.
Article 7 (Suspension of the Service)
The Company may suspend or interrupt the provision of all or part of the Service without prior notice to the User for the following reasons:
- When performing maintenance or updating the computer system for the Service
- When the Service cannot be provided due to force majeure such as earthquakes, lightning strikes, fires, power outages, or natural disasters
- When computers or communication lines are stopped due to accidents
- When the Company otherwise determines it is difficult to provide the Service
Article 8 (Usage Restrictions and Deregistration)
The Company may, without prior notice, restrict a User's use of all or part of the Service or cancel the User's registration if the User:
- Violates any provision of the Terms
- Is found to have registered with false information
- Causes damage to the Company or other Users
- Otherwise engages in inappropriate use of the Service
Article 9 (Withdrawal)
Users may withdraw from the Service by following the prescribed withdrawal procedure.
Article 10 (Disclaimer and Warranty)
The Company does not guarantee that the Service is free from defects in fact or law. The Company shall not be liable for any damages arising from the User's use of the Service.
Article 11 (Change of Service Content)
The Company may change the content of the Service or discontinue the Service at its convenience without prior notice.
Article 12 (Amendment of the Terms)
The Company may revise the Terms as necessary. Revisions shall take effect upon being posted on the Company’s website.
Article 13 (Handling of Personal Information)
The Company will appropriately handle personal information obtained through the use of the Service in accordance with its privacy policy.
Article 14 (Notification or Communication)
Notifications from the Company to Users shall be made via email or posted on the Service. Users are deemed to have received the notification once it is sent or posted.
Article 15 (Prohibition of Transfer of Rights and Obligations)
Users may not transfer or assign their rights or obligations under these Terms to any third party without the prior written consent of the Company.
Article 16 (Governing Law and Jurisdiction)
These Terms shall be governed by Japanese law. Any disputes arising in connection with the Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court.
